Abschnitt 11 – 11 Control Measures in Product Certification

11.1 To determine whether the manufactured products continue to conform to the tested type, whether production quality is assured, and whether the certification mark is being used legitimately, the Testing and Certification Body shall carry out control measures, if for the product in question

  1. a.

    the control measures are provided for in EU legislation,

  2. b.

    the GS Mark or the DGUV Test Mark has been awarded or

  3. c.

    other arrangements for carrying out control measures were agreed upon with the Applicant.

The cost of control measures are to be borne by the Applicant. The costs are determined by the Fee Schedule in force at the time the control measures are taken.

11.2 If not regulated by EU legislation, standard control measures are:

  1. a.

    Product testing,

  2. b.

    Production monitoring through auditing and certification of a product-related QAS.

11.3 Product testing as control measure

The holder of a certificate allows for control tests on the current production of products and manufacturing facilities at any time and at the holder's own expense. The holder shall ensure that the auditor has access to the appropriate operating facilities at any time and without advance notice during normal business hours and that the auditor is entitled to take products from the current production without charge. These tests are usually carried out once a year by the manufacturer or importer. Statutory repeat testing or additional testing may additionally be performed.

11.4 Production Monitoring through auditing and certification of a product-related QAS

If the Applicant has a QA System that has already been certified by an accredited certification body, it will be checked as to whether the existing certification is sufficient or whether, if necessary, a supplementary auditing and certification must be made.

11.5 Measures taken when discrepancies are found

The Testing and Certification Body shall evaluate the discrepancies identified during control measures and may take the following actions depending on the severity of the defects:

  • Request correction of the defects or

  • Suspension or modification of the certificate or

  • Withdrawal of the certificate.

11.6 The Testing and Certification Body may also implement alternative control measures, such as testing of products after removal from the market, at its sole discretion. If the product differs from the certified type, the costs shall be borne by the Applicant. The results of the alternative control measures may lead to a change or changes of the scope and depth of the control measures.
