Abschnitt 10 – 10 Product Certification

10.1 The certification body shall review the product in accordance with the certification criteria (see Section 9.2). After a positive decision, a certificate will be issued (e. g. GS Certificate, EC Type-Examination Certificate, DGUV Test Certificate, Type Test Certificate). The conformity of the type with the German Product Safety Act, relevant EU legislation or other occupational safety and health requirements shall be stated on the certificate in accordance with the order placed.

This does not necessarily imply full compliance with the specifications listed on the certificate under "Testing based on".

The Applicant shall receive a copy of the certificate.

10.2 A negative decision shall be communicated to the Applicant, stating the reasons.

10.3 Before the GS Mark can be awarded to the Applicant for the first time, the Testing and Certification Body shall inspect the factory if no product-related quality assurance system (QAS) certified by the Testing and Certification Body is in place. For DGUV Test Marks, the Testing and Certification Body will decide whether a factory inspection is to be performed.

10.4 If a certificate is issued, the certificate-holder:

  • shall always fulfill all certification requirements, including the implementation of appropriate changes, if these were communicated by the certification body,

  • shall ensure that the product continues to meet the product requirements, if the certification refers to ongoing production of the product,

  • shall take all necessary precautions that enable the conducting of the test and monitoring, including the testing of documentation and records, access to the sites and areas/divisions and to personnel and subcontractors and

  • shall take the necessary precautions for the investigating of complaints and the participation of observers.

10.5 The Testing and Certification Body shall be immediately informed of any planned changes to be made in regards to the manufacturing of the products with respect to the type and that are relevant for the purposes of the certification carried out. This also applies if parts installed have a different origin than the previously used parts. The Testing and Certification Body shall decide - if necessary by a re-testing - if the certificate will remain valid. The costs for the re-testing are to be borne by the Applicant. The costs are determined by the Fee Schedule applicable at the time of the testing.

10.6 Furthermore, the certificate-holder shall immediately inform the Testing and Certification Body about the relocation of the manufacturing site or the transfer of the manufacturing site to another company/other proprietor. If an inspection of the new manufacturing site by the Testing and Certification Body becomes necessary after changing the manufacturing site, the Applicant shall permit it. The costs of the inspection are to be borne by the Applicant.

10.7 The holder of the certificate is to record all third-party complaints relating to the occupational health and safety requirements for the manufactured products, as well as the actions hereupon taken, and shall immediately inform the Testing and Certification Body.

10.8 The certificate-holder shall notify the Testing and Certification Body in writing of the following:

  • change of names,

  • change of address or contact address,

  • change of legal form,

  • change of ownership,

  • cessation of business,

  • bankruptcy.
