Abschnitt 9 – 9 Product Testing

9.1 Testing is usually comprised of the testing of documents, including instruction manuals/operating instructions and the testing of the type.

9.2 The testing is carried out on the basis of the Testing and Certification Requirements. The bases are in particular:

  1. a.

    Testing as a notified body

    1. 1.

      basic occupational safety and health requirements of EU legislation,

    2. 2.

      harmonized standards (EN standards) relating to the EU legislation or the test specifications referred to under letter b),

    3. 3.

      recommendations/decisions of the European and the national coordination groups,

  2. b.

    Other tests

    1. 1.

      the German Product Safety Act,

    2. 2.

      national occupational safety and accident prevention regulations,

    3. 3.

      generally accepted rules of technology, e. g. DIN standards, VDE rules, EN standards, ISO stancards, IEC standards, VDI guidelines, supplementary test requirements, such as recommendations/decisions of the national coordination groups or additional contractually agreed requirements.

If the test specifications and test requirements for the product in question are compiled in test principles, these will generally be used for the test.

9.3 The testing of the type is carried out at the Testing and Certification Body or at a place that has been mutually agreed upon with the Testing and Certification Body. Tests that do not take place at the Testing and Certification Body shall be carried out on premises that are suitable for those tests.

9.4 Operational or ready-for-use types in the number specified by the Testing and Certification Body as well as the necessary tools and spare parts are to be provided for the tests free of charge. Deviations from this are to be agreed upon with the Testing and Certification Body (e. g. concept and development-related tests).

9.5 Bulky test objects may be delivered only after prior consultation with the Testing and Certification Body.

9.6 The Applicant shall, at the request of the Testing and Certification Body, ensure that an appropriate number of trained personnel are available to handle the test objects and give the necessary information.

9.7 If the type to be tested is delivered to a third party, the Applicant shall obtain from that third party a declaration of consent to conduct the test.

9.8 The Testing and Certification Body is allowed to enter and inspect the manufacturing site of the product to be tested. The result of the inspection shall be attached to the test documentation.

9.9 The Testing and Certification Body shall prepare a test report concerning the carrying out of the test of the type as well as the results of the test. The Applicant shall receive a copy of the test report.

9.10 The Testing and Certification Body reserves the right to keep the type for comparison purposes or to allow the Applicant to keep the type for comparison purposes.

If storage of the test object in the Testing and Certification Body is not necessary after the test, the test object will be made available after release for pickup for six weeks. If the test object is not taken back within this period, the Testing and Certification Body is entitled to send the test object back at the expense of the Applicant, to store the test object at the expense of the Applicant or to scrap the test object at the expense of the Applicant.
