Abschnitt 7.4 - 7.4 Legal bases for the tests

The legal provisions for testing work equipment, (machines, systems and the like) can be found in the Ordinance on Industrial Safety and Health.

The operator of the work equipment has to specify test lists, as well as type and scope of the tests for individual application conditions within the framework of a risk assessment and has to implement the tests accordingly. Legal provisions and recommendations of the manufacturer have to be observed.

Explanations in this context are contained in the technical rule on operational safety TRBS 1201. The test provisions of previous DGUV Regulations and safety rules still can be used to support the specification of the scope of testing and test intervals.

The tests must only be implemented by authorized persons instructed by the employer. An authorized person in the meaning of the Ordinance on Industrial Safety and Health is a person who, on the basis of the vocational training, the professional experience, and the contemporary professional activity, has the expertise for testing work equipment, see technical rules for operational safety TRBS 1203 "Befähigte Person" (Authorized person)".

The test results have to be documented and maintained in accordance with TRBS 1201.
